Terms of Service

1. Acceptance of Terms

By creating an account or using the Practical Love Crisis Assessment Tool ("the Tool"), you agree to these Terms of Service. If you do not agree, do not use the Tool.

2. Nature of the Tool

The Tool is a psychoeducational support application designed as a companion to the Practical Love: Suicide Awareness & Mandated Reporting Training, developed by Phil Bracco, LMFT, NJ Approved Supervisor.

The Tool is explicitly NOT any of the following:

• Not therapy or clinical assessment. Using this Tool does not create a therapist-client relationship.
• Not crisis counseling or emergency dispatch. If someone is in immediate danger, call 911. For crisis support, call or text 988.
• Not a medical device. This Tool is not FDA-regulated and does not diagnose, treat, or prevent any condition.
• Not a HIPAA-compliant system. Do not enter protected health information (PHI).
• Not a substitute for professional judgment. Always defer to licensed clinicians and emergency services.
• Not state-approved continuing education. Completion of training and use of this Tool does not constitute CE credits unless separately approved by a licensing board.

3. Intended Users

This Tool is intended for individuals who have completed the Practical Love training program. It is designed for pastors, ministry leaders, teachers, coaches, volunteers, and other non-clinical professionals who may encounter individuals in crisis. It is not intended for use by the general public as a self-assessment or self-help tool.

4. User Responsibilities

• Use the Tool only as a decision-support aid, not as a sole basis for action
• Follow all applicable laws regarding mandated reporting in your jurisdiction
• Do not enter personally identifiable information (PII) about the person you are assessing
• Do not share your account credentials with others
• In all cases of immediate danger, contact 911 before using this Tool
• Maintain your own records in compliance with your organization's policies

5. AI Situation Advisor

The AI Situation Advisor uses artificial intelligence to provide psychoeducational guidance based on the Three-Track System framework. AI responses are generated algorithmically and may not be accurate or appropriate for every situation. The AI Advisor:

• Does not provide clinical advice, diagnosis, or treatment recommendations
• May produce incorrect or incomplete information
• Is not a substitute for calling 911, 988, or consulting a licensed professional
• Should be used only as one input among many when determining your response

6. Jurisdiction Notice

The crisis hotlines, reporting procedures, and legal references in this Tool are based primarily on New Jersey law. Mandated reporting laws, definitions of abuse and neglect, and crisis response procedures vary significantly by state and jurisdiction. If you are outside New Jersey, you are responsible for knowing and following your own state's laws.

7. Limitation of Liability

THE TOOL IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. RESTORE COUNSELING NJ AND PHIL BRACCO, LMFT, SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF OR INABILITY TO USE THE TOOL.

The Tool is a decision-support aid. The user assumes full responsibility for all actions taken based on or informed by the Tool's output, including the decision to report or not report suspected abuse or danger.

8. Indemnification

You agree to indemnify and hold harmless Restore Counseling NJ, Phil Bracco, LMFT, and their affiliates from any claims, damages, or expenses arising from your use of the Tool or your violation of these Terms.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the Tool after changes are posted constitutes acceptance of the revised Terms.
